Darby Stearns Thorndike Kolter &
Ware, LLP has an active environmental and
land use practice representing parties in
local municipal zoning matters and
state-wide Act 250 permitting cases as well
as representation of clients in permitting
matters before the Vermont Agency of Natural
Resources (ANR). The representation
continues in decisions appealed from the
towns, Act 250 District Commissions and ANR
to the Vermont Environmental Court.

in enforcement matters brought by the State
of Vermont.

Special Needs Planning
Darby Stearns Thorndike Kolter &
Ware, LLP provides special needs planning
for individuals who have been disabled since
birth or became disabled due to an injury or
accident later in life. Special needs
planning requires consideration of a broad
range of legal and financial issues,
including an understanding of special (or
"supplemental") needs trusts, eligibility
standards for various governmental benefits,
estate, gift and income taxation and
guardianship issues. In the right
circumstances, the use of a special needs
trust can be crucial in helping to ensure
that disabled individuals have the financial
resources (now and in the future) to support
their needs without losing their eligibility
for public benefits such as Supplemental
Security Income (SSI) and Medicaid.
